The Confederation of Jews of France and Friends of Israel took note of the psychiatric expert report concerning Kobili Traoré, presumed author of the murder of Mrs. Sarah Halimi who was defenestrated on April 4 in Paris.
This report had to answer two crucial questions that were raised by this appalling affair:
- Whether, at the time of the events, Kobili Traoré's discernment was "total, altered or abolished",
- Knowing whether the abominable assassination of Madame Sarah Halimi was motivated by the anti-Semitism of the aggressor
The Confederation of Jews of France and Friends of Israel takes note of this report which answers these two questions.
As we said above, the first of the crucial questions raised by this case was whether, at the material time, Kobili Traoré's discernment was total, altered or abolished (which would have put an end to the criminal proceedings) .
The fact that the expert psychiatrist, Daniel Zagury, answered "Altered" to the question asked, suggests that Kobili Traoré will be sent back to an assize court at the end of the investigation. This can only satisfy and reassure us in view of the concerns raised at the start of the investigation.
Doctor Daniel Zagury pursues and concludes that the attacker was subject to a “acute delirious puff (…) induced by the increase in cannabis consumption” (ten to fifteen joints per day).
Despite this, he clearly answers the second question by concluding that "The crime of Kobili Traoré is a acts delirious and anti-Semite », which can only satisfy us because it puts an end to an interrogation which was undue and incomprehensible given the circumstances!
In view of this report, it clearly appears that the alleged assassin of Mrs. Sarah Halimi is responsible for his actions and that he acted motivated by his anti-Semitism.
And so even, he would have acted under the influence of narcotics (which is contradicted by the biological analyzes contained in the investigation file and which, contrary to the statements of the suspect, show that the doses of narcotics absorbed by the suspect are insignificant), it is not clear how this could be interpreted, criminally, as a circumstance "mitigating" even though this should be considered, on the contrary and obviously, as an "aggravating" circumstance.
Indeed, is the fact that a driver is responsible for an involuntary homicide under the influence of alcohol or narcotics not considered as an aggravating circumstance (Article 221-6-1 of the Code of Road) and in no way any extenuating circumstance in the laws of the Republic?
So why would it be any different on the occasion of a savage, anti-Semitic-motivated crime?
But this is a question that only the judge and the prosecutor can and will have to answer us and is in no way a question that should be asked of the doctor!
The Confederation of Jews in France and Friends of Israel considers that, in the present circumstances, a second opinion would be useless insofar as this report enables the Public Prosecutor and the Investigating Judge to give a favorable response to the request of the family and theTruth and Justice Support Committee for Sarah Halimi ”: criminal responsibility of Kobili Traoré and reclassification of crime with aggravating circumstance for anti-Semitic motivation.
However, we will remain vigilant on the legal consequences of the investigation, hoping that the above elements will be deemed sufficient by the examining magistrate to requalify the nature of this abject crime.
Finally, we are impatiently awaiting the follow-up to the complaint for non-assistance to persons in danger.
The French who love justice and equity, and the Jewish community of France in particular, expect justice to be intractable in the face of all anti-Semitic crimes committed on national territory, crimes which are multiplying as we have seen. demonstrate the cowardly aggression in Livry-Gargan against the family of our friend Roger Pinto.
The Confederation of Jews in France and Friends of Israel will not give up in its determination to fight uncompromisingly against racism and anti-Semitism.
It calls for dissuasive sanctions, the only way to put an end to the scourge of anti-Semitism.

Thank you, Mr. Abitbol, for this ultimatum but, in the Sarah Halimi affair, is it only racism and anti-Semitism? Couldn't the CJFAI also have to fight against something else?
Let me respond to two of your thoughts:

Absolutely. Even the horrific murders in 1969 of Sharon Tate and her friends by a group of hyper-dangerous individuals who took drugs on LSD: Death sentence commuted to life imprisonment.
But aren't we in the good land of France and haven't we inherited this beautiful thought that is neoliberalism or "ultra-liberalism", philosophical thought - or more exactly Marxist sociology at two cents - which comes to us directly from the Frankfurt School? Poor little Traoré, he was under the influence of drugs! And whose fault is it? But to us, the ugly, mean, white and racist society!
