Let us briefly recall the history of the Case: April 4, 2017 – assassination in abominable conditions of Mrs. Sarah Halimi Attal (z”l)!

So it happened on April 4, just 3 months ago!

That night, Mrs. Sarah Halimi ATTAL, an Orthodox Jewish woman, doctor, was surprised in her sleep at home! She will be horribly tortured for over an hour. She was 65 years old and lived in a modest building in the XNUMXth arrondissement of Paris, rue Vaucouleurs. The murderer, a "radical Islamist" who had constantly pestered and harassed her with anti-Semitic slurs during the preceding weeks, had entered her home that night through the balcony and relentless with incredible violence on his victim, causing around twenty fractures to the body and face, before throwing him out of the window, dying, from the third floor. The story of the violence and acts of barbarism suffered by the victim are simply unbearable to describe and reflects an indescribable anti-Semitic hatred!

During this time, the police (immediately notified) are on the landing. The first crew of three armed men does not intervene. Five minutes later, a second crew arrives which will be followed fifteen minutes later by a third crew. In fact, we will know later that in the end, there will be 28 police officers on site, but that they will not intervene throughout the ordeal of the sexagenarian, up to and including the defenestration!

This challenges and shocks more than one citizen, Jewish or non-Jewish, obviously with the exception of Maître Buchinger! To be precise and to realize the enormity of the dysfunction, it is important to take up the exact course of the facts as clarified by Sammy Ghozlan during the Press Conference of July 4:

• The police arrived 3 minutes after they were called by the neighboring Malian family, since Kobili TRAORE had passed through the latter's accommodation to access that of Sarah HALIMI.
• 4:22 am: call from the Malian family
• 4:25 a.m.: LAC arrives on scene; she receives the keys sent by the family and at the same time she declares hearing cries which she likens to Arab prayers.
• 4:30 am: arrival of the 2nd crew
• 4:48 a.m.: arrival of the 3rd crew (in the end, there were 28 members of the security forces)
• 5:32 a.m.: defenestration of Mrs. Sarah Halimi Attal

Thus fifty minutes elapsed between the arrival of the police and the death of Mrs. Halimi.

During all this time, the neighbors (several dozen people) hear his screams and this, up to three blocks from the building. They try to intervene but are dissuaded by the police for security reasons. It will appear, after investigation, that the national media were not alerted either by AFP or by the prefecture! Consequently, they do not investigate and ignore the abominable assassination!

Worst of all, it is that this terrible drama was able to take place in the middle of Paris without anyone being moved by it, nor reporting the affair. Not only were the media silent, but both the political, associative and artistic worlds remained just as silent, with the notable exception of Mrs. Marine Le Pen who was moved by the situation during an interview with Le Figaro. ! Worse still, on April 7, three days after the events, the so-called organized Jewish community prided itself on a press release in which it wrote “Nothing allows us to retain the anti-Semitic character and nothing allows us to exclude it. The investigation is continuing and all leads are open... However, we have full confidence in the men and women who are working on this investigation... The investigation cannot be done on social networks, the mixing of information from direct witnesses with stories “revisited” by commentators, the mixture of verified and proven information with supposed, imaginary, desired or even denied information creates confusion that serves the search for truth. » This press release shocked a large number of Jews and non-Jews who absolutely did not understand the relevance and the usefulness of such a press release which gave food for thought to those who wanted to avoid the qualification of anti-Semite at this heinous crime! Thus, after the various anti-Semitic acts that took place from February to the end of May 2017, and passed over in silence, we had to continue the omerta and refuse to mention the anti-Semitic track in the Sarah Halimi investigation! Thus this anti-Semitic crime, no more than the many others that occurred during the presidential campaign, was not mentioned during this period! However, we have known our journalists to be much more zealous in the “Theo affair”, as well as the many artists who had so promptly mobilized on this occasion! Such an organized silence deserves at least an explanation, a decryption! It is to break this deafening silence that a Support Committee " Truth and Justice for Sarah Halimi » has formed! This is how an appeal from 17 of the most talented intellectuals appeared in Le Figaro on June 9 with the well-intentioned aim of putting an end to OMERTA! With, it must be recognized, a mixed success! But it was still a start! The Support Committee Truth and Justice for Sarah Halimi » , which was joined by the Confederation of Jews in France and Friends of Israel, then mobilized to highlight two dark points of this affair and had as its primary desire that a point be made on the 2 main problems raised. in that case :

• why the aggravating circumstance of anti-Semitism was not retained
• and how to justify the completely incomprehensible and unusual non-intervention of the police.

In this context, the Support Committee " Truth and Justice for Sarah Halimi » announces a press conference with Maître Gilles-William GOLDNADEL, lawyer for the ATTAl family, William ATTAL, brother of the victim and Sammy Ghozlan, president of the BNVCA, in order to take stock of the legal situation. Strangely, it was then, on Sunday July 2, that Maître Alexandre BUCHINGER, lawyer for the victim's daughters, felt obliged to communicate on the reasons for its non-complaint for “Non-assistance to person in danger ». Maître GOLDNADEL will explain at length the reasons for the complaint against the police, on July 4, during the press conference of the “Truth and Justice for Sarah Halimi” Support Committee. He will be supported in his demonstration by the statements of MP Meyer Habib and Sammy Ghozlan. So much for the facts!

DECRYPTION Several malfunctions therefore appear on reading the events described above and which we are trying to decipher!

• First of all, why have we witnessed such media silence in the face of an abominable crime whether this attack was considered anti-Semitic or not!
• Then, why didn't the Prefect of Police and the Public Prosecutor immediately alert AFP and the media, and above all, why didn't they communicate as they usually do?
• Why did you immediately consider the aggressor as a psychiatric patient?
• Why was there a delay in considering this crime as an anti-Semitic act, or even a terrorist attack of an anti-Semitic nature? (the aggravating circumstance of anti-Semitism has still not been retained despite the declarations of Mr. Gérard Collomb, Minister of the Interior).
• Why does the Jewish community say " organized » was she so timorous and so inactive in the face of the dysfunction of the police?
• Why was Maître Buchinger, one of the civil party lawyers, so virulent towards another civil party lawyer?
• Why are the authorities refusing to initiate an investigation into the dysfunction of the police, which they nevertheless immediately did in the Théo affair or in the Shaoyo Liu affair?

MEDIA SILENCE The media silence is particularly deafening, especially when compared to the commotion that followed the Theo and Shaoyo Liu cases that took place a few weeks earlier! How can this be explained given the seriousness of the attack? Regardless of the anti-Semitic nature of the case, this attack was, to say the least, a particularly heinous common law crime! Neither the prefecture nor the prosecutor sent a press release to AFP on the night of the crime! Even the white march did not arouse the slightest media emotion. White march, itself, triggered spontaneously by the Jewish street deeply moved, shocked and disgusted by what they had just learned. This White March which will take place on April 9 at the foot of the building where Madame Halimi lived will itself be punctuated by anti-Semitic jeers and the throwing of objects at the demonstrators. This nauseous environment of anti-Semitism is enough, on its own, to demonstrate the anti-Semitic climate that surrounded Mrs. Halimi's living environment!

But that day, April 9, nearly a week after the heinous crime, the press headlined: “A white march took place in Paris in tribute to the woman of the Jewish faith who fell from the third floor of his building. A 27-year-old neighbor is suspected to have defenestrated it." Even though everyone knew that the poor lady had been defenestrated by an Islamist neighbor and that he had been arrested in flagrante delicto!

We will learn later that the media only really react after receiving an AFP dispatch which will only arrive after the first press release from the Support Committee which followed the appeal of the 17 intellectuals on June 1 on Le Figaro! That's almost two months after the start of the business! The dubious attitude that emerged from the press release of the “so-called organized” Jewish organizations certainly did not help the press agencies to realize the seriousness of the situation! We had to wait for the press release from the Support Committee “ Truth and Justice for Sarah Halimi » so that the press is moved and moved, starting with a first report on TF1 on June 28! As Master GOLDNADEL so rightly says, this assassination has nothing to do with a community crime, but is a French crime."It is even symptomatic of a French evil - even if the Jews are the main victims, they are not the only ones - what is the media apathy inherent in the embarrassment that seizes intellectual, media, political society French as soon as the assassin is an Islamist.”

THE SILENCE OF THE AUTHORITIES Just as serious as the silence of the media, we must note the silence of the authorities. No press release either from the Prefect, or from the Public Prosecutor, or from the Minister of the Interior and even less from the President of the Republic! On April 30, 2017, at the occasion of the National Day of Deportees from France, Emmanuel MACRON, candidate for the Presidency of the Republic, will go to Memorial of the Holocaust and Memorial of the Martyrs of Deportation without mentioning the “Sarah Halimi affair” and without this affair being mentioned by her hosts! Mrs. Halimi's home was a few kilometers from the Memorial and no one thought of going to the foot of the building where Mrs. Halimi lived or going to the bedside of the family as François Hollande had done for Theo! The silence of the authorities was accompanied by the muffled and embarrassed murmur of the representatives of the “so-called organized” Jewish organizations! The silence of the authorities in this affair, a silence which continues to this day, will long resonate in the conscience of the Jewish people of France! PSYCHIATRATION On the spot, as soon as they arrived on the spot and as soon as the murderer was arrested, the police, followed in this direction by the courts, decided to intern the murderer of Sarah HALIMI, Kobili TRAORE, rather than having him pass by the prison box (he is still in a closed psychiatric center to this day). However, this defendant, although having a heavy legal past, had no psychiatric history. Certainly, he was particularly enthusiastic, but as are all radical Islamists, particularly hateful, and I would even say as are all anti-Semites! He was, in any case, hardly crazier than the one who girds himself with an explosive belt before blowing himself up and who, themselves, were entitled to incarceration in high security detention. Thus, there again, this prejudice of psychiatrization, reveals the desire to avoid penal discussion. In any event, an expert has been appointed, in the person of Dr Daniel ZAGURY, whose rigor and reputation are well established, and in whom we place our full trust. We do not want to prejudge his decision, which may, however, be challenged, if necessary. THE AGGRAVATING CIRCUMSTANCE OF ANTISEMITISM As Master Goldnadel so rightly says: "It seems to me that the Islamist who massacres, with the cries of Allah Akbar, a person identifiable as a Jewish nun is part of the Islamist's "kit", and that this represents an almost irrefutable indication that his act is anti-Semitic. In addition, there is now in the file both the testimony of Sarah HALIMI's daughter indicating that she had complained that Kobili TRAORE's sister had insulted her with anti-Semitic terms, and that of Sarah's brother that Kobili TRAORE himself called her a “dirty Jew”. Without prejudging the decision of the examining magistrate, and without wanting to impugn his intentions, we would not understand that today, on the basis of testimonies which appear today in the file and which were not present at the beginning of the procedure, the aggravating circumstance of anti-Semitism is not retained even though the Minister of the Interior, Mr. Gérard Collomb, recognized on June 28, the manifestly anti-Semitic nature of this assassination! THE FRILOSITY OF THE SO-CALLED ORGANIZED JEWISH COMMUNITY Another subject of concern for the Jewish community, traumatized by the events that have followed one another for 15 years, is the timorous, resigned and reserved attitude of the "so-called organized" Jewish organizations. The leaders of these organizations, after a particularly cautious press release (see above), resolved to recognize the anti-Semitic character of this crime and to demand its recognition by the authorities! But they remain paralyzed by a possible questioning of the police, or even of the underlying political decisions! These officials not only refuse to lodge a complaint for non-assistance to a person in danger in accordance with article 223-6 of the Penal Code, but also exert pressure so that no one else acts in this direction. However, article 223-6 of the Penal Code specifies: "Anyone who can prevent by his immediate action, without risk for himself or for third parties, either a crime or an offense against the bodily integrity of the person who voluntarily refrains from doing so is punished by five years' imprisonment and A fine of 75 euros. Will be punished with the same penalties anyone who voluntarily refrains from providing a person in danger with the assistance that, without risk for him or for third parties, he could lend him either by his personal action, or by causing relief. This is exactly our case! Their positioning was, unfortunately, taken over by Maître Buchinger THE COMPASSIONATE AND UBUESQUE REFLECTIONS OF MASTER BUCHINGER Independently of the strange legal arguments of Master Buchinger, his compassionate reflections towards the Police and the Justice inspire us some reflections. First of all, on the legal argument, Maître Buchinger himself said in his press release that: “If the police forces had intervened immediately in the moments following their arrival, Sarah HALIMI would still be alive. There was indisputably a police dysfunction which led to the total inertia of the police forces during the interminable ordeal of Mrs. Sarah HALIMI. » This is the textbook case of non-assistance to a person in danger as defined by article 223-6 of the Penal Code. Act all the more serious as it emanates from police forces. Master Buchinger forgets that a complaint has the mission of seizing an Investigating Judge whose sole mission is to reveal the truth. In French law, contrary to Anglo-Saxon law, the Judge instructs for and against, and that only a complaint allows an in-depth investigation into the circumstances of the malfunctions which led to the death of Mrs. Halimi. This duty of truth, we owe it not only to the family, but to the whole Nation! Strange to consider that it is more judicious to question the Investigating Judge through article 82-1 of the Code of Criminal Procedure which provides that the civil parties can make "requests for acts of investigation" at the magistrate in charge of the investigation. In a way, it is the right to ask him to carry out research or to conduct hearings that he has not yet commissioned on his own initiative. This possibility generally applies to a few investigative acts, whereas Maître Buchinger, by requesting the interrogation of all the police officers (several dozen) and demanding the response of each of them to 14 questions, in addition to the interrogation of all eyewitnesses or others, Master Buchinger arrogates himself as Master of the investigation! The Investigating Judge will appreciate! Indeed, Master Buchinger proclaims: “I have made a request for an action to the investigating judge so that all the police officers who have been called upon to intervene in the context of this affair are heard and that 14 specific questions are asked of them. I also requested the hearing of all the eye and hearing witnesses who have already been heard beforehand so that they can shed light on the attitude of the police and the context of the intervention. He affirms in his compassionate reflections towards the Police and the Justice that it would have cast suspicion on these institutions to ask for the opening of an investigation. But did President François Hollande, Prime Minister Bernard Cazeneuve or the Ministers of the Interior and of Justice cast suspicion on the police forces and the judicial authorities when they called for an investigation both in the Adam Traoré, Théo or Shaoyo Liu cases? Of course not ! It is precisely because we have enormous respect for the Forces of Order and the judicial authorities that we would like all the light to be shed on the terrible dysfunctions of this night of April 4, it is so that such tragedies do not happen again that we ask for an investigation of the services. Know the source of the fault! Understand where the error in the chain of command comes from, whether it comes from the police authority or the political authority! Yes it is useful, it is even imperative to know the truth to restore confidence in a community that doubts! Rightly or wrongly, she doubts! And our role is to reassure her! Yes, we owe this truth to the Halimi family, we owe it to our institutions and we owe it to the Nation! No offense to Maître Buchinger, the normal procedure in a democracy is to lodge a complaint when one becomes aware of a misdemeanor or a crime! It is not only a wish but an obligation, a duty whose omission is criminally reprehensible! Maître Goldnadel is therefore doing his duty as a citizen and lawyer by filing this complaint on behalf of his clients. Complaint which was one of the two demands of the Support Committee!
